If the common law marriage has to be recognized, then one of the first conditions that has to be met is that you should be living together. Another condition to be fulfilled is that you should be introducing each other to people like married couple.
One way of doing is by having the same last name. You can also file tax returns jointly and so on. There is no time line defined as to how many years a couple should be staying to together to be recognized under this marriage laws. Also, when you are interviewed as a couple, you should show clear intentions that you wish to get married. The Social Security Administration will recognize the marriage only if your state of residence allows common law marriage.
